The Terms and Conditions (TAC) of this document are a legal Agreement (User Covenant) between you, being a User as an individual, a customer, a partner and the beneficiary of our services provided by www.flyturizm.com and Travel and Trade Ltd. (hereinafter referred to as FLY Turizm). Both sides are also collectively referred to as "the Parties" and individually as "the Party".
By navigating through and using our website for the services we render, you accept, declare and undertake that you have read the User Covenant, completely understand the content and approve all the provisions.
The User is responsible for their Account (under any screen name or Password) and for ensuring that all use of the Account complies fully with the provisions of this Agreement.
User shall be responsible for protecting the confidentiality of their password(s) and credit/debit cards against third-party access. FLY Turizm has no responsibility, directly or indirectly, relating to any loss suffered by Users and/or third persons because of the User's negligence to secure, preserve and protect their account and access to the FLY Turizm Portal.
Users accept, declare and undertake that information and content provided by them on the FLY Turizm portal are correct and legal. FLY Turizm is not obliged to investigate the correctness of uploaded, changed or provided information resulting from a User's fault or negligence.
Users cannot assign their rights and obligations within the scope of the User Covenant, partly or wholly, to any third person/party without written permission of FLY Turizm.
Users accept, declare and undertake that they will avoid behaviors which may manipulate the operation of the FLY Turizm Portal; otherwise, FLY Turizm will seek compensation for any resulting loss.
FLY Turizm may terminate the membership of a User found not to abide by the provisions of this User Covenant, temporarily or permanently.
FLY Turizm shall have the right at any time to change or discontinue any aspect or feature of its portal.
FLY Turizm reserves the right to update the TAC at any time without notice. The most current version can be reviewed via the "Terms and Conditions" link at the bottom of our website.
By using our services, you confirm that you are at least 18 years old, or the age of legal majority in your jurisdiction, and that you have the full legal capacity to enter into a binding agreement with FLY Turizm.
If you are using the service on behalf of a company or organization, you confirm that you are authorized to bind that entity to this Agreement.
FLY Turizm is an online travel portal mainly for air ticket booking, dedicated to providing quality services to its partners/clients. We have access to ticketing with more than 700 airlines, including low-cost carriers, around the world.
Our portal will gradually extend and launch other planned travel & tourism related services in the near future, such as hotel bookings, car rentals, cruises, and vacation packages.
The services, including any updates, enhancements and new features, are subject to the TAC.
The FLY Turizm portal's material, trademarks and other proprietary information — including but not limited to text, software, photos, videos, and graphics of www.flyturizm.com — are copyrighted as a collective work under international copyright laws.
The User may not modify, publish, transmit, transfer, sell, or otherwise exploit any content, in whole or in part, for purposes that may harm our business or reputation.
If any FLY Turizm service requires the User to open an account, the User must complete the registration process by providing current, complete and accurate information. The User will choose a password and username and is responsible for maintaining their confidentiality, as well as for all activities occurring under the account, including misuse of credit/debit cards.
The User agrees to notify FLY Turizm immediately of any unauthorized use of their account or any other breach of security. FLY Turizm will not be liable for any loss resulting from someone else using the User's password, account or cards, with or without the User's knowledge; however, the User may be held liable for losses caused to FLY Turizm or another party as a result. The User may not use anyone else's account without the account holder's permission.
You should secure your information by installing security measures such as anti-virus programs on the devices you use to access the service.
Do not give your information to any person or institution offering a loan or an award. Avoid websites or blogs containing such ads, and notify us by phone if you receive suspicious notifications regarding payment matters.
Through our hosting and technical infrastructure, we provide a high level security system meeting world-class network, data and physical security standards, updated regularly in accordance with changing conditions and trends.
We apply the necessary measures through SSL, PCI DSS and 3D Secure within the scope of security.
SSL (Secure Sockets Layer) is used by the FLY Turizm server to ensure the safe transfer of data between our Users and the system, using encoding equal to the standards used by banks.
PCI DSS (Payment Card Industry Data Security Standard) is used by our portal to ensure card information security in credit/debit card payment systems, developed by the PCI Committee formed by Visa, Mastercard, American Express, Discover and JCB International.
3D Secure, also known as Payer Authentication, is an XML-based protocol designed as an additional security layer for online card transactions, developed by Visa and Mastercard to secure both cardholders and member enterprises against fraud.
Your use of the FLY Turizm portal is also governed by our Privacy Policy, which explains what information we collect, how we use it, and the choices available to you.
By accepting this Agreement, you also acknowledge and accept our Privacy Policy.
1. Cancellation: Any ticket can be cancelled upon request and will be handled according to the airline's rules for applicable fees and cancellation penalties, taking the most restricted fare class into consideration.
2. Refunds: (a) Airline Operation Failure — either the full ticket amount is refunded to the passenger, or the ticket is reissued with a new date based on the passenger's request; this applies when the airline fails to operate the flight and it is cancelled, and may take up to 48 hours for airline approval. (b) No-show ticket — after approval by the concerned airline, the customer can receive the relative refund, but only once FLY Turizm receives the refund from the airline.
3. Reissue: (a) Changes — any ticket can be changed upon request based on the airline's reissue rules; airline fees apply and more restricted fare classes are taken into consideration. (b) Flight cancellation — if the flight is cancelled by the airline, the reissue is processed free of charge, though it may take longer while awaiting airline approval.
4. Void: A ticket can be voided/cancelled within the same day, taking time-zone differences into account. The entire paid amount will be refunded to the customer's account. Void applies to all GDS-based airlines; low-cost carrier tickets cannot be voided according to their airlines' rules.
FLY Turizm and the User will not be responsible for any failure or delay in performing their obligations due to circumstances beyond their reasonable control, including war, riots, embargoes, acts of civil or military authorities, natural disasters, fire, floods, accidents, power or network failure, failures of third-party service providers, and any other unavoidable Force Majeure event.
FLY Turizm accepts no responsibility for interruptions in the use of our services due to errors, loss or deletion of User information, communication delays, computer viruses, or unauthorized entry into User records resulting from the User's misuse of the FLY Turizm Portal without our permission.
FLY Turizm has the right to immediately terminate a User's account with the FLY Turizm Portal in the event of any conduct which FLY Turizm, at its sole discretion, considers unacceptable, or in the event of any breach of this Agreement's terms and conditions by the User.
This Agreement shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law principles.
If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of this Agreement shall remain in full force and effect.
This Agreement, together with our Privacy Policy and any other terms referenced herein, constitutes the entire agreement between you and FLY Turizm regarding your use of our services, and supersedes any prior agreements or understandings, whether written or oral.
If any dispute, difference, controversy or claim arises out of or relates to this Agreement (a "Dispute"), the Parties (the Customer and FLY Turizm) shall attempt to settle it through mutual discussion.
If the Dispute cannot be settled by mutual understanding and discussion, it shall be submitted to binding arbitration by one arbitrator mutually appointed by the Parties.
The award of the arbitrator shall be final, conclusive and binding upon the Parties and may be entered as a judgment in any court having jurisdiction over either party.
